1.Acceptance of Terms

1.1Agreement

These Terms of Use govern your use of BetweenActs. By creating an Account or otherwise using the Service, you agree to be bound by these Terms of Use.

1.2Related Documents

The BetweenActs Privacy Policy explains what information we collect and how it is used, shared, kept and deleted.

The videos in the app come from YouTube, through YouTube API Services. By using BetweenActs you also agree to be bound by the YouTube Terms of Service: https://www.youtube.com/t/terms. Our Privacy Policy says what YouTube can see when a video player is open.

2.Definitions

2.1The Parties

“We”, “us” and “our” mean Bryght Ideas, LLC, 2850 North Sheridan Road, Chicago, Illinois 60657, USA, which runs BetweenActs.

“You” and “your” mean the individual who uses the Service. “Member” means any person who has an Account.

2.2The Service and Accounts

“BetweenActs” and “the Service” mean the BetweenActs app, which is for keeping a record of the theater you see.

“Account” means the account that you create in order to use the Service.

2.3Content and the Catalogue

“Content” means what you put into the Service, including your diary entries, ratings, reviews, lists, rankings and photos.

“Catalogue” means the shared catalogue of shows, theaters and related information that all Members use.

3.Eligibility

3.1Minimum Age

BetweenActs is for people 13 and over. You may not use the Service if you are under 13.

3.2Accounts of Children Under 13

If at any point we learn that an Account belongs to someone under 13, we will delete it. If you think a child under 13 is using BetweenActs, tell us at support@bryghtideas.com.

4.Your Account

4.1Account Required

You need an Account to log shows. There is no password. You sign in with a one-time code sent to your email address (or, if you add one, by text to your phone), or with a passkey.

4.2Your Details

The details that you give us should be your own.

4.3Responsibility for Your Sign-In

You agree to keep your sign-in to yourself. Anything done from your Account is treated as done by you.

4.4Deleting Your Account

You can delete your Account at any time, from Account, then Security, inside the app. The Privacy Policy states exactly what that removes.

5.The Service

5.1Description

BetweenActs is an app for keeping a record of the theater you see. You log the shows you attend, rate and review them, build a personal ranking, plan the shows you have tickets for, and follow what is playing on Broadway, in the West End and on tour.

5.2Preview Status

We are still in preview. Things will change, features will move, and there will be days when something is broken. We will do our best, but we cannot promise that the app is always available.

5.3Use of Artificial Intelligence

We use AI to help build and run the app. The Privacy Policy has a section, How We Use Artificial Intelligence, that says how.

6.User Content and Licence

6.1Ownership of Your Content

What you write stays yours. Your diary entries, ratings, reviews, lists, rankings and photos belong to you, not to us.

6.2Licence to Us

By putting something where other Members can see it, such as a public diary entry or review, your rankings, your Must See list, a public list, or your profile and its photos, you permit us to show it inside the app and to store it so that it can be shown.

You also permit us to count your ratings, without your name, in each show's audience score. That includes ratings on entries that you keep to Only me.

These permissions end when you delete the Content or your Account.

6.3Visibility Settings

Your profile and your diary entries are public unless you choose otherwise. You can make your profile private, and mark any single entry Only me. The Privacy Policy states exactly what each setting hides.

6.4Catalogue Requests and Photos

If you ask us to add a show or a theater that we do not carry, what you typed may be used to add it to the Catalogue. A Catalogue entry is not yours, and it stays if you leave.

A photo that you send with a program scan or a show request, or add as a show's cover, is used to identify the show and check its details, and is shown only to you.

7.Acceptable Use

7.1Conduct Toward Others

You agree to be a decent audience member. You agree not to post anything abusive, hateful, threatening or harassing, and not to post someone else's private information.

7.2Identity and Rights in Content

You agree not to impersonate another person, and not to post Content that you do not have the right to post. That includes your profile and cover photos.

7.3Misuse of the Service

You agree not to use the app to advertise, to run bots or scrapers against it, or to try to break, overload or get around its limits.

7.4Genuine Logging

You agree to log only shows that you actually saw. Fake ratings and reviews would make the rankings worthless for every Member.

8.Accuracy of Information

8.1Show Information

Show details, such as dates, theaters, casts, closing dates and tour stops, are gathered from public sources. We make every effort to keep show information correct, and every show is approved by a member of the BetweenActs team before it is published.

If you see something wrong, tell us at support@bryghtideas.com. You should check with the theater or the seller before you plan around a date.

8.2AI-Assisted Content

We use AI to help build and run the app, including to gather public information to fill in show details and to write show synopses in our own words. Section 8.1 applies to all such information: each show is approved by a member of the BetweenActs team before it is published.

8.3Member Reviews

Reviews are opinions, yours and those of other Members. We do not check them for accuracy, and a review in the app is not a statement by BetweenActs.

9.Third-Party Links and Tickets

9.1Tickets

BetweenActs does not sell tickets. A ticket button opens the seller's own website inside the app. Anything you buy there is between you and that seller, on their terms, including their prices, their fees and their refunds.

9.2Other Websites

News stories, critic reviews and other links open someone else's website. We do not control those sites and are not responsible for what they say or do.

9.3Third-Party Content

Critic scores, news stories and videos in the app come from outside sources and belong to whoever made them. We link out to the original wherever we can.

10.Subscriptions and Paid Plans

10.1Current Status

The app is free to use today. It shows the paid memberships that we plan to offer, marked Coming soon, but none of them can be bought yet and nothing in the app charges you.

10.2Before Any Paid Plan Opens

Before any paid plan opens, its price and what it includes will be shown to you before you are asked to pay for anything.

10.3Placeholder Information

All information in the subscription area is a placeholder. Every Account is free during testing, and details of paid plans will come before any billing starts.

11.Termination

11.1Termination by You

You can stop using BetweenActs whenever you like, and you can delete your Account from Account, then Security, inside the app.

11.2Suspension or Closure by Us

We can suspend or close an Account that is breaking the rules in section 7. Where it is reasonable to do so, we will tell you why first.

11.3Effect of Termination

If your Account ends, your Content goes with it. The Privacy Policy lists the few things that stay, none of which names you.

12.Disclaimers

12.1“As Is” and “As Available”

BetweenActs is provided “as is” and “as available”.

13.Limitation of Liability

13.1Indirect and Consequential Losses

To the extent the law allows, Bryght Ideas, LLC is not liable for indirect or consequential losses.

13.2Cap on Liability

Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or US$50 if you paid us nothing.

13.3Liability That Cannot Be Limited

Nothing in these Terms of Use limits any liability that the law does not allow to be limited.

14.Governing Law and Disputes

14.1Governing Law

These Terms of Use are governed by the law of the State of Illinois, USA.

14.2Courts

If a dispute comes up, it goes to the courts in Cook County, Illinois, unless the law where you live says you can use your own courts as a consumer.

15.Changes to These Terms

15.1Updates

These Terms of Use will change as the app grows. When we change something that matters, we will update the date at the top of this page and tell you in the app.

15.2Continued Use

Carrying on using BetweenActs after a change means that you accept the new version. If you do not, you can delete your Account.
